The DPDP Act creates a heavier tier of obligation for organisations whose data processing carries more risk: the Significant Data Fiduciary (SDF). If you are designated one, several extra duties switch on.
How you become an SDF
Under Section 10, the Central Government can notify any Data Fiduciary or class of fiduciaries as significant, weighing factors such as the volume and sensitivity of personal data processed, the risk to Data Principals, risk to electoral democracy, security of the State, and public order. There is no single number — it is a risk-based designation, and it can apply to a whole sector.
The extra obligations
- Appoint a Data Protection Officer — based in India, reporting to the board, as the point of contact (see our guide on whether you need a DPO).
- Appoint an independent data auditor to evaluate your DPDP compliance.
- Carry out a Data Protection Impact Assessment (DPIA) — under the Rules 2025, once every 12 months — and a periodic audit, with findings reported to the Board.
- Algorithmic due diligence — ensure the algorithmic software you use (including AI) does not pose a risk to Data Principals' rights.
- Observe any additional measures the government specifies, which can include restrictions on transferring certain personal data outside India.
What a DPIA involves
A DPIA is a structured review of a processing activity: what data, what purpose, what risks to individuals, and what safeguards reduce those risks. Done once every 12 months (and for new high-risk processing), it is both a compliance artefact and a genuinely useful risk tool.
Audit: proving it, not just claiming it
The independent audit is the difference between asserting compliance and demonstrating it. An DPDP audit tests your notices, consent, security, breach-readiness, rights handling and vendor contracts against the Act and Rules, and produces evidence you can show the Board.
If you might be an SDF, prepare early
Designation can arrive by notification with limited lead time. If your data volume or sensitivity is high — large consumer platforms, fintech, health, ed-tech, telecom — it is prudent to stand up the DPO, DPIA and audit muscle before you are formally named, not after.
How DPDP Bridge helps
DPDP Bridge supports the heavier SDF duties end to end — DPDP audit, Data Protection Impact Assessments, data mapping and a DPO — so designation does not catch you unprepared. The free assessment returns an indicative SDF answer in about ten minutes.
